RewardPal Deals - Contest Rules

OFFICIAL CONTEST RULES AND REGULATIONS

MINIMUM OF ONE REWARDPAL DEAL PURCHASE IS NECESSARY: A MINIMUM OF ONE PURCHASE OR PAYMENT OF ANY MONEY IS NECESSARY TO ENTER. All federal, state and/or local rules and regulations apply. Void where prohibited by law.

1. Eligibility: Open to Michigan residents who have reached the age of majority under the laws of the jurisdiction in which they reside at the time of entry. Employees of RewardPal Inc., advertising and promotion agencies involved in the Contest, the Contest sponsors (RewardPal Inc. and such others, collectively, the “Sponsors”) are not eligible.

2. Entrants May Enter Online By: Entrants must enter a valid email address and First, Last names at www.RewardPalDeals.com. Only one entry online per email address is allowed. In the event of multiple entries originating from a single e-mail address, only the first entry submitted will be the official entry. Internet entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. By entering online, entrants agree to opt-in and receive marketing emails from RewardPal Inc. You may opt out of receiving future e-mails from RewardPal Inc. by clicking on the link contained in the initial e-mail. You will remain eligible for this Contest whether or not you opt out of receiving email alerts from RewardPal Inc.

There is no limit to the total number of Contest entries per eligible and registered participant. Each month, RewardPal Inc. calculates your total number of Contest entries eligible for each monthly Contest. Qualified Contest entries must be obtained within the same month of the prize drawing. You may collect more than one Contest entry by purchasing additional RewardPal deals from www.RewardPalDeals.com. One Contest entry is equal to one RewardPal Deal purchase.

3. Prize: Every calendar month, one (1) Apple iPad with 16 Mega Bytes Storage and WiFi enabled, valued at $499, will be given away to one eligible contestant qualified to receive RewardPal Inc. daily email alerts. The Contest winners are responsible for any and all applicable fees and taxes associated with prize receipt and use.

4. How to Win: The prize winners will be selected on or about the last day of each month through a random drawing of all eligible Contest entries received each month. All drawings will be held at RewardPal Inc. offices. Odds of winning depend on the number of eligible Contest entries received each month. All drawings will be conducted and judged by RewardPal Inc., whose decisions and interpretations of these Official Rules shall apply and be final and binding.

Winners will be notified either by mail, e-mail and/or telephone. If a winner does not respond and meet the below requirements within three (3) business days of attempted contact, RewardPal Inc. reserves the right to randomly select an alternate winner from the names of all entries that did not win a prize. In order to receive a prize, winners may be required to sign a Liability Release and, where legally permissible, a publicity release, and may also be required to provide additional information (which may include, but not be limited to tax information), waivers and releases. Winners will have three (3) business days to provide all such information and to execute and return the Liability Release and publicity release (if required by RewardPal Inc.). These documents will, among other things, release the Released Parties from any claims, losses, injuries or damages of any kind resulting from participation in the Contest or the use or receipt of any prizes, and allow the use of the winner’s name and likeness. Failure to comply with the foregoing, or the return of any prize or prize notification as undeliverable, may cause the winner to forfeit their prize and RewardPal Inc. reserves the right to select an alternate winner.

5. Odds of Winning the Contest: The odds of winning the Contest depend upon the total number of eligible entries per participant. The Contest winning odds improve by increasing the number of Contest entries through RewardPal Deal purchases.

6. Limitation of Liability: By entering this Contest, entrants agree to be bound by these Official Rules, and agree to release the RewardPal, and their employees, officers, agents and directors (the RewardPal, and such others, collectively, the “Released Parties”), from any and all liability for injuries, losses or damages of any kind resulting from participation in this drawing and/or use or acceptance of any prize.

7. Contest Conditions: This Contest is void where prohibited by law. Incomplete entries or responses will be disqualified. The Released Parties are not responsible for any lost, late, misdirected, stolen or undelivered entries. The Released Parties are not responsible for technical, network, electronic, computer, hardware or software failures of any kind, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any materials in the Contest. The Released Parties are not responsible for incomplete or delayed Internet/e-mail computer entries. In the event that technical or other circumstances compromise this drawing, RewardPal Inc. reserves the right to cancel, modify or terminate the Contest, and the right, but not the obligation, to select winners for prizes from all eligible entries received prior to the cancellation. The Released Parties are not responsible for typographical errors in the Contest site or these rules. RewardPal Inc. reserves the right to share entry information with any other Released Parties.

8. Disqualification: In the event that a winner fails to claim his or her prize within 30 days of notification or fails to meet the eligibility requirements of the contest, the un-awarded prize will be awarded to an alternate winner selected at random from remaining entries.

9. Marketing and Advertising: Except where prohibited by law or regulation, winner’s acceptance of prize will constitute permission for RewardPal Inc. and the other Released Parties to use winner’s name, likeness, and statements for any purpose in reference to the Contest and this promotion without additional compensation, consideration or consent.

10. Miscellaneous: RewardPal Inc. reserves the right to change or replace the prize at any time with a prize of equal or greater value. The prize is not transferable, assignable nor redeemable for cash. All Federal, State and Local laws and regulations apply. Winners will be responsible for all Federal, State or other applicable taxes in connection with the receipt of prizes.

11. Disputes: In the event of a dispute as to the identity of a person who has entered online, the entrant will be deemed the authorized account holder of the email address submitted at the time of entry. The authorized account holder is defined as the natural person who is assigned an email address by an internet service provider, an online service provider or any other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.

12. Governing Law: Entrants agree that the Contest shall be governed by the laws of the State of Michigan and: (1) any and all disputes, claims and causes of action arising out of or connected with the Contest, the interpretation of the Official Contest Rules, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, court costs; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Damages”), and (4) entrant hereby waives all rights to claim Damages and all rights to have such damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by and constructed in accordance with the laws of the State of Michigan.
